Taichung Customs stated that any export commodity should be marked the country of origin in accordance with the Regulations Governing Export of Commodities. Any exported commodity which failing or untruthfully being marked the country of origin as required will be withdrawn under regulations, and the case will be handed over to the Bureau of Foreign Trade, Ministry of Economic Affairs (BOFT) for imposing penalties.
Taichung Customs also stated that any export commodity produced in the Republic of China shall be marked itself or its internal and external package with the country of origin in a conspicuous and durable manner, according to Article 20 of the Regulations Governing Export of Commodities. But if such a marking cannot be made in accordance with these regulations due to the special characteristics of the commodity or the special situation of its packaging, the exporter shall apply to the BOFT for an approval. Furthermore, according to Article 21 of the same regulations, any export commodity manufactured in the Republic of China shall be marked with “Made in Republic of China,” “Made in Taiwan, Republic of China,” “Made in Taiwan” or the equivalent in a foreign language.
Taichung Customs further explained that most of the common cases of incorrectly marking on export commodities they had found were failing to mark the country of origin as required, such as having no country of origin labelling, being marked with “Taiwan Area,” “Taiwan, China,” “MADE IN TAIWAN CHINA,” and so forth.
Taichung Customs reiterated that exporters for exportationn declaration failed to or untruthfully marked the country of origin as required, the Customs will withdraw the goods under regulations, and the case will be handed over to the BOFT. Exporters can’t be completely exempted from the responsibility for the administrative penalty by claiming their unawareness of the law. Therefore, exporters and customs brokers should check the country of origin of their goods and mark them correctly before export declarations in order to protect their rights and interests.
